Summary:
On May 15, 2024, Kaitlyn Bachman, Beth Schardine, and Ty Whetten were accused of aggravated kidnapping, robbery, and assault.
They had intended to deliver divorce mediation papers to Darick Morrell, a Uintah County Corrections Officer. However, Darick, armed with his service handgun, discharged his weapon during the encounter. Fearing for their safety, Kaitlyn and Ty attempted to flee but were apprehended by police and taken to the Uintah County Jail.
On May 15, 2024 our world was turned upside down when my daughter, Kaitlyn Bachman, along with her friends Beth Schardine and Ty Whetten, were charged with the heavy crimes of aggravated kidnapping, aggravated robbery, and aggravated assault.
As Beth waited in an SUV outside the home, Kaitlyn and Ty entered the home of Darick Morrell. The door had opened when they knocked. Darick is a Uintah County Corrections Officer, who works at the Uintah County Jail. Ty and Kaitlyn had come with the intent to present Darick with papers, a motion for mediation in his divorce.
The police magically appeared—without being called—seconds after they entered the home. Darick came down the stairs armed with his service handgun.
When he saw Ty and Kaitlyn, he ran back up stairs. Ty, who almost always carries, grabbed his gun for protection. Shortly after, Darick came down the stairs and shot his gun. Luckily the bullet went through the wall and into the adjoining residence.
With the fear of being shot, Kaitlyn and Ty were left with no choice but to run for their very lives. However, their escape was cut short when they were met by police officers, who, instead of providing safety, handcuffed them and transported them to the police department and then to the Uintah County Jail. This is the same jail where Darick works.
Kaitlyn, Beth, and Ty are confronting significant legal issues in Vernal, Utah, with multiple infringements on their constitutional rights. Examples include being denied bail before they were booked, despite no prior infractions. It took over a month to receive public defenders, despite requesting legal counsel at the police department.
The assigned public defenders have repeatedly postponed hearings without client consultation, leading to excessive jail time. Ty and Beth have experienced prolonged solitary confinement, with periods extending for multiple consecutive days, which exceeds the limit of the required daily hour outside of confinement.
We call upon the Uintah County District Court to reflect on the situation objectively, considering the circumstances under which events unfolded, and take the necessary steps towards justice.
This begins with dropping all charges against Kaitlyn Bachman, Beth Schardine, and Ty Whetten, along with their immediate release from their respective jails. Furthermore, we request that Darick Morrell be charged with attempted murder and other appropriate charges.
